1. Introduction
1.1AfriAsante Agency (“AfriAsante”, “we”, “us”) respects your privacy. This Privacy Policy explains how we collect, use, share and protect personal information when you use www.afriasante.co.za (the “Website”), contact us, apply to join our roster, or buy our services.
1.2We comply with the Protection of Personal Information Act 4 of 2013 (“POPIA”). For POPIA purposes, AfriAsante is the “responsible party”.
1.3By using the Website or giving us your personal information you acknowledge this Policy. Where we need your consent (for example to publish a Talent profile), we will ask for it separately and you may withdraw it at any time.

3. Personal information we collect
“Personal information” means information that identifies you (or, where applicable, a company). Depending on how you use the Website, we may collect:
- Enquiries and contact: name, email address, phone or WhatsApp number, company, role and the content of your message.
- Talent applications: name, contact details, age or date of birth, location, languages, talent category, biography, social media handles and follower or reach figures, photos, videos or voice samples, and any other information you choose to include.
- Account information: name, email, phone, company details, role, login credentials (stored in protected form) and account activity.
- Bookings and payments: billing name and address, VAT number, quotations, invoices and payment status. Card details are entered with our payment provider and are not stored by us.
- Testimonials: your name, organisation and the feedback you provide.
- Technical information: IP address, browser and device type, pages visited, dates and times, security and session tokens, and cookie data.
- Communications: emails and WhatsApp messages exchanged with us.
3.1Special personal information. We do not ask for information about religion, race or ethnic origin, health, sex life, political or trade union views, biometric data or criminal history. Please do not include it in applications or messages. If a Talent chooses to share any such information (for example, for a casting requirement), we will process it only with explicit consent or as the law allows.
3.2Children. The Website is not aimed at children. We process the personal information of a person under 18 only with the prior consent of a parent or legal guardian, or where POPIA otherwise permits.
3.3Public information. For Talent and Client vetting we may view publicly available social media profiles and metrics.
4. How we collect information
We collect information directly from you (forms, email, WhatsApp, calls, meetings), automatically through the Website (cookies and server logs), and from public sources such as your social media profiles. Where we receive information about you from someone else (for example a Client naming a contact), we expect that person to have the right to share it.
5. Why we use your information
We process personal information only for specific, lawful purposes, and only where the processing is necessary for a contract with you, required by law, protects a legitimate interest of yours or ours, or you have consented:
- to respond to enquiries and provide quotations;
- to assess Talent applications, manage the roster and match Talent with Client campaigns;
- to conclude and perform Booking and Management Agreements, including invoicing, payments and Talent payouts;
- to create and manage accounts and dashboards;
- to publish Talent profiles, campaign case studies and testimonials (with consent);
- to run, report on and improve campaigns and the Website;
- to keep the Website secure, and to detect and prevent fraud and abuse;
- to comply with tax, accounting and other legal obligations; and
- to send you news, opportunities or marketing, where you have opted in or POPIA allows, with an easy way to opt out.
We will not use your information for a purpose that is incompatible with the purpose it was collected for, unless the law allows it or you agree.
6. Who we share information with
We do not sell your personal information. We share it only as needed with:
- Clients, where Talent have agreed to be pitched or featured, or where Client contact details are required to run a campaign;
- Service providers (“operators”) who process information on our behalf under written agreements requiring confidentiality and security, such as web hosting, email, payment processing, analytics, and cloud storage providers;
- Professional advisers, such as accountants, auditors, insurers and legal advisers;
- Authorities, courts or regulators where we are required to by law or to protect our legal rights; and
- A successor to our business, if it is sold or restructured, subject to this Policy.
Published Talent profiles and campaign pages are visible to anyone who visits the Website.
7. Cross-border transfers
Some of our service providers (for example email, cloud or analytics tools) may store or process information outside South Africa. We transfer personal information across borders only where the recipient is subject to law, binding corporate rules or a binding agreement that gives an adequate level of protection, where you consent, or where the transfer is otherwise permitted by section 72 of POPIA.
8. How long we keep information
We keep personal information only as long as needed for the purpose it was collected, or as the law requires. Our usual periods are:

When no longer needed, information is deleted or de-identified.
9. Security
9.1We take reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access or disclosure. These include encrypted (HTTPS) connections, hashed passwords, role-based access controls, CSRF protection, secure hosting and regular backups.
9.2No system is completely secure. If a security compromise affects your personal information, we will notify you and the Information Regulator as soon as reasonably possible, as POPIA requires.
10. Cookies and similar technologies
10.1The Website uses cookies and similar technologies. Essential cookies keep the Website working and secure (for example session and security tokens). Analytics or functional cookies, if any, help us understand how the Website is used.
10.2You can manage or block cookies in your browser settings. Blocking essential cookies may stop parts of the Website, such as login, from working.
11. Your rights
Under POPIA you have the right to:
- ask whether we hold personal information about you and request access to it;
- request correction or deletion of information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;
- object, on reasonable grounds, to the processing of your information, and object at any time to direct marketing;
- withdraw consent you have given, without affecting processing already done lawfully;
- not be subject to a decision based solely on automated processing that significantly affects you; and
- lodge a complaint with the Information Regulator.
To exercise these rights, email our Information Officer using the details in section 2. We may need to verify your identity first, and some requests may be limited where the law allows or requires us to keep the information. Requests for access to records are also governed by the Promotion of Access to Information Act 2 of 2000 (“PAIA”).

13. Third-party websites
The Website links to third-party sites and services (such as Instagram and WhatsApp). We are not responsible for their privacy practices. Please read their policies before sharing your information.
14. Changes to this Policy
We may update this Policy from time to time. The latest version will be on the Website with the “last updated” date. If changes are significant, we will take reasonable steps to tell you.
